Flipe Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Flipe mobile application and all related services (collectively, the “Service”).
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is operated by Individual Entrepreneur “Gaiane Arutiunian”, Georgia (“Flipe”, “we”, “our”, or “us”).
1. Eligibility
You must be at least 13 years old to use the Service.
If you are under the age required by the laws of your country to enter into a legally binding agreement, your parent or legal guardian must review and accept these Terms on your behalf.
2. License
Subject to these Terms, Flipe grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service on compatible devices that you own or control, solely for your personal, non-commercial use and in accordance with the applicable usage rules of the Apple Media Services Terms and Conditions or any other applicable app marketplace.
This license does not transfer ownership of the Service or any intellectual property rights to you. You may not rent, lease, sublicense, distribute, sell, modify, reverse engineer, decompile, disassemble, or create derivative works of the Service except where expressly permitted by applicable law.
3. Service Description & Non-Streaming Disclaimer
Flipe is strictly a private, personal discovery and joint decision-making tool designed to help users match movie and TV preferences with a partner or friend.
NO VIDEO STREAMING OR HOSTING: Flipe is NOT a video streaming service, media host, or content distributor. The Service does NOT play, stream, broadcast, download, or host full-length movies, TV episodes, or video files.
THIRD-PARTY PLATFORMS: Any links, buttons, or redirects within the Service showing where content is available for streaming (e.g., via JustWatch) are provided solely for convenience. Flipe does not control and is not responsible for the availability, licensing, pricing, or content of third-party streaming platforms.
4. Apple App Store Terms
If you obtained the Service through Apple’s App Store, you acknowledge that these Terms are entered into between you and Flipe, and not with Apple Inc.
Apple is not responsible for the Service or its content.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
Flipe is solely responsible for providing any maintenance and support for the Service. Apple has no obligation to provide maintenance or support services.
To the maximum extent permitted by law, Apple has no warranty obligations regarding the Service.
Apple is not responsible for addressing claims relating to the Service, including but not limited to product liability claims, legal or regulatory compliance claims, consumer protection claims, privacy claims, or intellectual property claims.
5. Accounts and Private Joint Sessions
You may create an account using:

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to provide accurate information and keep it up to date.
Private Joint Sessions: The Service allows you to initiate private swipe sessions and view matched titles with a chosen partner via direct invitation links or code sharing. Account data, avatars, and saved preferences are private and non-public. You are solely responsible for managing who receives your session invitation links. Flipe is not liable for unauthorized access to your joint session resulting from your sharing of invitation links.
6. Subscriptions and In-App Purchases
Some features of the Service require a paid subscription or one-time in-app purchase.
Subscriptions are billed through your Apple App Store account and automatically renew unless canceled at least 24 hours before the end of the current billing period.
Payment will be charged to your Apple ID account upon confirmation of purchase.
You may manage or cancel your subscription at any time through your Apple ID account settings.
Deleting the application does not automatically cancel an active subscription.
7. Acceptable Use
You agree that you will not:
impersonate another person or organization;
create fake or misleading accounts;
use bots, scripts, automation, or artificial methods to access the Service;
interfere with or disrupt the operation of the Service;
attempt to gain unauthorized access to servers, systems, databases, or APIs;
reverse engineer, decompile, or modify the Service except where permitted by law;
scrape, harvest, extract, copy, or collect data from the Service;
use the Service for commercial data mining or resale;
violate applicable laws or the rights of other users.
We reserve the right to suspend or terminate accounts that violate these Terms.
8. User Data and Personal Preferences
You retain ownership of the personal preferences, watchlists, saved matches, and likes/dislikes you generate within the Service ("User Data").
By using the Service, you grant Flipe a limited, non-exclusive, royalty-free license to store, process, sync, and display your User Data solely for operating, personalizing, and delivering the Service to you and your invited session partner. Flipe does not publish your User Data to any public directory or social feed.
9. Recommendations and Artificial Intelligence
Flipe uses recommendation technologies, including artificial intelligence and machine learning, to personalize movie and television recommendations.
Recommendations are intended solely to assist users in discovering content and do not constitute professional advice or guarantees.
Recommendation systems may analyze information such as ratings, watchlists, likes, dislikes, swipe activity, saved titles, and other interactions with movies and TV shows.
Certain recommendation technologies may be provided by third-party service providers. Where external AI services are used, only anonymized or de-identified information is shared.
10. Third-Party Services
The Service relies on third-party providers for authentication, analytics, cloud infrastructure, crash reporting, recommendation technologies, movie metadata, and streaming availability.
Your use of those services may also be subject to their respective terms and privacy policies.
11. TMDB, JustWatch, and Third-Party Content
TMDB Attribution: Flipe uses the TMDB API but is not endorsed, certified, or otherwise approved by TMDB.
JustWatch Attribution: Streaming availability data within the Service may be powered by JustWatch.
Copyright Ownership: Movie titles, TV titles, posters, artwork, trailers, cast information, descriptions, and other related media materials displayed within the Service belong to their respective copyright owners. Flipe does not claim ownership of such third-party intellectual property.
12. Intellectual Property
The Service, including its software, user interface, design, algorithms, logos, graphics, branding, trademarks, and original content, is owned by Flipe or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws.
Except as expressly permitted by these Terms, no part of the Service may be copied, reproduced, distributed, modified, published, or exploited without prior written permission.
13. Copyright Complaints (DMCA / Takedowns)
If you believe that content available through the Service infringes your copyright, please contact us at: support@flipe.app.
Your notice should include:
Identification of the copyrighted work claimed to have been infringed;
Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it;
Your contact information (address, telephone number, email);
A statement of good-faith belief that the use is unauthorized;
A statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
We reserve the right to remove or disable access to allegedly infringing material and to terminate access for repeat infringers.
14. Availability
We strive to provide a reliable Service but do not guarantee uninterrupted, secure, or error-free operation. We may modify, suspend, discontinue, or remove features at any time without prior notice.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE.”
Flipe disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Flipe shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, interruption of business, or loss of goodwill arising from your use of the Service.
Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.
17. Export Compliance
You represent and warrant that:
you are not located in a country subject to a U.S. government embargo; and
you are not listed on any U.S. government list of prohibited or restricted parties.
You agree not to use or export the Service in violation of applicable export control laws.
18. Termination
You may stop using the Service at any time. We may suspend or terminate your account immediately if you violate these Terms or if necessary to protect the Service, our users, or applicable law.
Upon termination, the license granted under these Terms automatically ends.
19. Governing Law
These Terms are governed by the laws of Georgia, without regard to conflict of law principles.
If mandatory consumer protection laws in your country of residence provide you with additional rights, those rights remain unaffected.
20. Changes to These Terms
We may revise these Terms from time to time. Updated Terms become effective when published within the Service or on our website. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
